Employment Pass rejected: appealing or reapplying
Only the employer or the authorised third party that filed the application can appeal an Employment Pass rejection — MOM will not take an appeal from the candidate. The appeal goes through EP eService within 3 months of the rejection, and MOM says the outcome will not change without new information that addresses the reasons in its rejection advisory. MOM processes 85% of appeals within 6 weeks. After 3 months, the only route is a new application.
Key takeaways
- Who: the employer or authorised third party that submitted the application. Not the candidate.
- When: within 3 months of the rejection, through EP eService. Later than that, apply afresh.
- What: new information that addresses MOM's stated reasons. MOM: “There will be no change in the outcome unless there is new information in the appeal.”
- MOM's list of things to address includes the qualifying salary and COMPASS, qualification-verification inconsistencies, the job-advertising requirement and IRAS tax matters.
- Timing: 85% of appeals are processed within 6 weeks.
Start with MOM's rejection advisory
MOM gives its reasons: the rejection advisory in EP eService shows them with advice on what to do next, and a manual application's rejection letter does the same. Everything else follows from reading it properly — an appeal that does not answer the advisory is, in MOM's words, not going to change the outcome.
Issues MOM names
MOM's appeal page says supporting documents and remarks are not needed where the problem has simply been fixed, and lists the fixes it has in mind. Read as a list of what goes wrong, they are:
| Issue in the advisory | What an appeal can show | Where to read more |
|---|---|---|
| Salary below the qualifying salary (Stage 1) | A revised offer at or above the figure for the candidate's age; Stage 1 is a floor with no points to make it up | Employment Pass |
| COMPASS below the pass mark | Which criterion changed — usually C1 through a higher salary; C3, C4 and C6 depend on the employer | COMPASS explained |
| Qualification details inconsistent with the verification proof | Corrected details, and proof from a source MOM accepts | Documents |
| Job-advertising requirement not met | An advertisement that meets the Fair Consideration Framework — though a fresh 14-day advert may point to a new application instead | How an EP application works |
| IRAS tax matters | That the tax matter has been resolved | IRAS |
MOM also suggests running its Self-Assessment Tool before appealing. Where the problem is the numbers, the COMPASS calculator shows the salary needed for the next C1 band and the qualifying salary at the candidate's age.
Appeal or new application?
| Appeal | New application | |
|---|---|---|
| Deadline | Within 3 months of the rejection | Any time |
| Best when | The advisory names something the employer can now fix and evidence | Something basic has changed — a new role, a new employer, a new advertisement |
| Filed by | The employer or authorised third party who submitted | The employer (or the new employer) |
| Time | 85% within 6 weeks | Processed or updated within 10 business days online |
What the candidate can do
- Ask the employer for the advisory's reasons; MOM will not discuss the case with the candidate.
- Fix what is theirs to fix: qualification verification through an accepted source, consistent personal details, a tax matter.
- Talk to the employer about the salary if Stage 1 or C1 is the problem — it is the one number that moves both.
- Consider whether another pass fits better: the S Pass (employer quota and levy apply), or the ONE Pass for exceptional salaries or achievements.
S Pass rejections follow the same rules: 3 months, employer or authorised third party only, and 85% of appeals processed within 6 weeks. For permanent residence, ICA's category is for a holder of an Employment Pass or S Pass — see Employment Pass to PR.
See what would close the gap
The qualifying salary at the candidate's age, the salary needed for 10 or 20 C1 points in the employer's sector, and the COMPASS total — before the employer decides to appeal.
